Remember that your use of Ponyrun’s Services is at all times subject to our Customer Terms and Conditions. Any terms we use in this Privacy Policy without defining them have the definitions given to them in the Customer Terms and Conditions. Notwithstanding the foregoing, (i) if you entered into the Customer Terms and Conditions on behalf of an organization, “Services” as used in this Privacy Policy means only our website www.ponyrun.ai (or a sister or successor site or subpage) (the “Website”); and (ii) if you entered into the Customer Terms and Conditions on behalf of yourself and not on behalf of an organization, or you have used the Website or Platform without entering into the Customer Terms and Conditions, “Services” as used in this Privacy Policy means both the Website and the Platform. ‍

In the ordinary course of providing the Services, at the direction of our customers, we may process Customer Data consisting of or containing personal data about individuals. We are not the controllers of such personal data and our processing of such data is governed by the Customer Terms and Conditions or another written agreement executed by us and the applicable customer. The customer’s privacy policy or other agreement between the customer and you or your organization, and not this Privacy Policy, applies to such processing. If we process your personal data on behalf of one of our customers and you wish to discontinue such processing, or if you seek to correct, amend, or delete inaccurate data, please directly contact the customer on whose behalf we are processing such data. We will follow the customer’s instructions with regard to the data at issue. We will retain such personal data pursuant to our retention policy and will retain it as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. ‍

What this Privacy Policy Covers

Google API
Ponyrun’s use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

We may share any Personal Data that we collect with third parties in conjunction with any of the activities set forth under “Meeting Legal Requirements and Enforcing Legal Terms” in the “Our Commercial or Business Purposes for Collecting Personal Data” section above.  

Business Transfers
All of your Personal Data that we collect may be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business (in whole or in part). Should one of these events occur, we will make reasonable efforts to notify you before your information becomes subject to different privacy and security policies and practices. ‍

Data that is Not Personal Data
We may create aggregated, de-identified or anonymized data from the Personal Data we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified or anonymized data and share it with third parties for our lawful business purposes, including to analyze, build and improve the Services and promote our business, provided that we will not share such data in a manner that could identify you.  ‍

Google User Data
Access and Use of Google User Data
Our application offers users the ability to log in using their Google account and to export data to Google Sheets. To facilitate these features, we request certain permissions from Google to access your Google user data.When you log in using Google, we only access the basic profile information that Google provides (such as your name, email address, and profile picture) to create or update your user profile in our application. We do not access or store any other personal information from your Google profile.For the functionality of exporting data to Google Sheets, our application requests permission to access and manage your spreadsheets in Google Drive. This permission is solely for the purpose of creating new spreadsheets or updating existing ones with data you choose to export from our application. We do not access, use, or modify any other files in your Google Drive without your explicit consent.
Storage of Google User Data
Any Google user data accessed by our application is stored securely and is only kept for as long as necessary to provide the service or feature you have requested. Data exported to Google Sheets is stored in your Google Drive and is subject to Google’s own privacy policies and security measures.
Sharing of Google User Data
We do not share any Google user data obtained through our application with third parties unless it is necessary to provide the services requested by the user, to comply with the law, or to protect our rights.

You have the right to revoke our access to your Google user data at any time through your Google account settings. Additionally, you may request to access, correct, or delete any personal information we have collected from you.

Tracking Tools and Opt-Out
The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base and operate and improve our Services. If we learn we have collected Personal Data from a child under 13 years of age, we will delete that information as quickly as possible. We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time, but we will alert you to any such changes by placing a notice on the Ponyrun website, by sending you an email and/or by some other means.
